Terms of Use

These terms and conditions of use (hereinafter referred to as the "the Terms") set forth the terms and conditions of the electronic service (hereinafter referred to as the "the Service") provided by "Pseudo Imitation System" (hereinafter referred to as the "the Website") and the rights and obligations between you and the Website when you use the Service. Please read the Terms in their entirety before using the Service.

Article 1 (Application)

The purpose of the Terms is to define the rights and obligations between the Website and the User (as defined in Article 2) regarding use of the Service, and applies to all relationships between the User and the Website regarding use of the Service.

Any rules, provisions, or regulations regarding the Service provided on the Website that are posted from time to time shall constitute a part of the Terms. In the event of any inconsistency between such rules, provisions, etc. and the Terms, the former shall take precedence and apply.

Article 2 (Definitions)

  1. "Registered User" means an individual or corporation that has been registered as a member of the Service in accordance with Article 6.
  2. "Unregistered User" means any individual or entity that has not registered as a user in accordance with Article 6.
  3. "User" means collectively "Registered User" and "Unregistered User".
  4. "External SNS Service" means a social networking service provided by Google or other entities that has functions such as authentication of the Registered User and is used to implement the Service.
  5. "External SNS provider" means a service provider of External SNS Service.
  6. "External SNS Terms of Service" means the terms and conditions that define the relationship of rights between the Registered User and External SNS provider.
  7. "Intellectual Property Rights" means copyrights, patents, utility model rights, trademarks, design rights, and other intellectual property rights (including the right to obtain an interest in such rights or to apply for registration of such rights).
  8. The term "Copyright Holder, etc." means an author as defined in Article 2(2) of the Copyright Act, a performer as defined in Article 2(4), a phonorecord producer as defined in Article 2(6), or any other person who has rights under the Copyright Act.
  9. The term "right of private use, etc." means any act that does not infringe upon the rights under Articles 21 through 28 of the Copyright Act.
  10. "Anti-Social Forces, etc." means organized crime groups, members of organized crime groups, right-wing groups, antisocial forces, and other similar groups.
  11. "Personal information" and "personal data" mean personal information and personal data, respectively, as defined in the Act on the Protection of Personal Information (Act No. 57 of 2003, hereinafter referred to as the "Personal Information Protection Act").

Article 3 (Agreement to the Terms)

  1. The User may use the Service by registering as a member of the Service in accordance with Article 6 upon agreeing to the Terms.
  2. When the User agrees to the Terms, a contract of use in accordance with the various provisions of the Terms is established between the User and the Website.
  3. If the User is a minor, the User must obtain the consent of a person with parental authority or other legal representative before using the Service.
  4. If a minor User uses the Service by falsely claiming to have the consent of a legal representative even though he/she does not have such consent, by falsely claiming to be of legal age, or by using other fraudulent means to make the User believe that he/she is of legal capacity, any legal action related to the Service cannot be revoked.
  5. If a User who was a minor at the time of agreeing to the Terms uses the Service after reaching the age of majority, such User shall be deemed to have ratified the legal acts related to the Service.

Article 4 (Modification of Terms and Conditions)

  1. The Website may revise the Terms at any time without the consent of the User, and the User agrees to such revisions without objection.
  2. When the Website revises the Terms, it will notify the User of the revised Terms of Use in a manner prescribed by the Website.
  3. Revisions to the previous Terms and Conditions shall take effect from the time the Website gives notice in accordance with the preceding paragraph.
  4. By using the Service after the modification of the Terms, the User is deemed to have agreed to the modified Terms of Use without objection.

Article 5 (Handling of Personal Information, etc.)

Personal information and user information shall be handled appropriately in accordance with the Privacy Policy and Disclaimer separately stipulated by this site.

Article 6 (User Registration)

  1. The Unregistered User may register by agreeing to abide by the Terms and the Privacy Policy.
  2. The registration procedure must be completed by the individual or legal entity that will be using the Service, and as a general rule, applications for use of the Service by a proxy are not permitted.
  3. Upon completion of registration as stipulated in the preceding paragraph, the Terms of the Service in accordance with the various provisions of this agreement shall be established between the Registered User and the Website.
  4. The Website may at any time verify the identity of the Registered User and confirm that the registered information is true, and the Registered User shall provide the Website with the information necessary for such verification in writing, etc. upon request of the Website.

Article 7 (Account Management)

  1. The Registered User shall manage and store the registered information under his/her own responsibility, and shall not allow a third party to use, lend, transfer, change the name of, or sell the registered information.
  2. When a Registered User uses the Service, the Website may treat it as if the Registered User himself/herself used the Service, and the Registered User himself/herself shall be responsible for any and all consequences and liabilities arising from the use of the Service.
  3. If a Registered User discovers that his/her registration information has been stolen or is being used by a third party, the Registered User shall immediately notify the Website and follow instructions from the Website.

Article 8 (Use of the Service)

  1. An Unregistered User may not use the Service without user registration in accordance with Article 6.
  2. A Registered User may use the Service only during the period of valid registration as a Registered User, within the scope of the purpose of the Terms and without violating the Terms, and in accordance with the method prescribed by the Website.
  3. The preparation and maintenance of computers, software and other equipment, telecommunication lines and telecommunication environment, etc. (including the conclusion of contracts with External SNS providers, etc.) necessary for the provision of the Service shall be performed at the User's expense and responsibility. In addition, the User shall bear the communication costs incurred by the User in using the Service.
  4. The User shall take security measures to prevent computer viruses, unauthorized access, and information leaks in accordance with the User's usage environment.
  5. The Website assumes no responsibility for the preparation and maintenance of the user's usage environment.

Article 9 (Usage Fees and Payment Methods)

  1. As compensation for the paid portion of the Service, the User shall pay the usage fee indicated on the Website in a manner separately determined by the Website.
  2. If the User delays payment of the usage fee, the User shall pay a late fee at the rate of 14.6% per annum.

Article 10 (Prohibited Matters)

  1. Acts that violate laws and regulations or public order and morals
  2. Actions related to criminal acts
  3. Acts that infringe on copyrights, trademarks, or other intellectual property rights contained in the Service, including the contents of the Service
  4. Acts that destroy or interfere with the functioning of the server or network of the Website, other Users, or other third parties
  5. Commercial use of information obtained from the service
  6. Acts that may interfere with the operation of the Website's services
  7. Conducting or attempting to conduct unauthorized access
  8. Collecting or accumulating personal information about other Users
  9. Use of the Service for any unauthorized purpose
  10. Actions that cause disadvantage, damage, or discomfort to other Users of the Service or other third parties
  11. Impersonating another User
  12. Advertising, publicity, solicitation, or sales activities on the Service that are not authorized by the Website
  13. Actions for the purpose of meeting people of the opposite sex whom one has never met before
  14. Directly or indirectly providing benefits to antisocial forces, etc. in relation to the Website's services
  15. Other acts that the Website deems inappropriate

Article 11 (Suspension of Provision of the Service, etc.)

  1. The Website reserves the right to suspend or discontinue all or part of the Service without prior notice to the User for any of the following reasons.
    • When performing maintenance inspections or updating of computer systems related to the Service.
    • When the provision of the Service becomes difficult due to force majeure such as earthquake, lightning, fire, power outage, or natural disasters.
    • When computers or communication lines, etc. are shut down due to an accident.
    • In any other cases in which the Website deems it difficult to provide the Service.
  2. The Website shall not be liable for any disadvantage or damage incurred by the User or any third party due to the suspension or interruption of the Service.

Article 12 (Restriction of Use and Cancellation of Registration)

  1. The Website may, without prior notice, restrict a User's use of all or part of the Service or terminate the User's registration if the User falls under any of the following.
    • If any of the provisions of the Terms are violated.
    • When it is found that there is a false fact in the registration information.
    • When there is default in payment of fees and other obligations.
    • When there is no response to communications from the Website for a certain period of time.
    • When there has been no use of the Service for a certain period of time since the last use.
    • In any other cases where the Website deems the use of the Service to be inappropriate.
  2. The Website shall not be liable for any damages incurred by the User as a result of actions taken by the Website in accordance with this Article.

Article 13 (Withdrawal from Membership)

The User may withdraw from the Service by following the withdrawal procedure specified by the Website.

Article 14 (Disclaimer of Warranty and Disclaimer of Liability)

  1. The Website does not warrant, either expressly or implicitly, that the Service is free from defects in fact or law (including defects relating to safety, reliability, accuracy, completeness, effectiveness, security, etc., fitness for a particular purpose, errors or bugs, infringement of rights, etc.).
  2. The Website shall not be liable for any and all damages incurred by the User as a result of the Service, except in cases of intentional or gross negligence on the part of the Website. However, this disclaimer does not apply when the contract between the Website and the User regarding the Service (including the Terms) is a consumer contract as defined by the Consumer Contract Act.
  3. Even in the case of the proviso of the preceding paragraph, the Website shall not be liable for any damage arising from special circumstances (including cases where the Website or the User foresaw or could have foreseen the occurrence of a failure) among damages incurred by the User due to default or tort caused by the negligence (excluding gross negligence) of the Website.
  4. The Website is not responsible for any transactions, communications, or disputes between the User and other Users or third parties in relation to the Service.

Article 15 (Notice or Communication)

Notification or communication between the Website and the User shall be made by the method determined by the Website. Unless the User notifies us of a change in the contact information in accordance with a method separately stipulated by us, we will assume that the currently registered contact information is valid and send the notice or communication to that information, which will be deemed to have reached the User at the time it is sent.

Article 16 (Governing Law and Jurisdiction)

  1. The Terms shall be governed by and construed in accordance with the laws of Japan.
  2. In the event of any dispute regarding the Service, the court having jurisdiction over the location of the head office of the Website shall have exclusive jurisdiction.
